Parental Responsibility

The mother of a child automatically has parental responsibility for that child at birth. The married father of a child also has parental responsibility. If the father is not married to the mother but the child is born after the 1st December 2003 and the father is named on the child’s birth certificate, then again, he has parental responsibility. If he is not married to the mother and is not on the child’s birth certificate he does not have parental responsibility but can gain it if both parents sign a parental responsibility agreement or if the father applies to the court for an order. The father will also acquire parental responsibility if he marries the mother later.
